Our site is operated by the Parochial Church Council of the Parish of Wokingham (All Saints) which is established for charitable purposes, charity number 1127585 together with its representatives (“We“). We are located at the Parish Office, The Cornerstone, Norreys Avenue, Wokingham RG40 1UE.

User contributed information

All personal information will be dealt with in accordance with the Data Protection Act 1998 and the Privacy Policy.
Where you contribute information on any part of our site or a discussion forum you must comply with the provisions set out in these terms and conditions and particularly to the Discussion Forum Rules set out below.

Prohibited uses

These content standards apply to any and all material which you contribute (Contributions), to our site generally or through our discussion forum and to any interactive services associated with the site or the discussion forum.

Contributions must not:
Contain any material which is defamatory of any person.
Contain any material which is obscene, offensive, hateful or inflammatory.
Promote sexually explicit material.
Promote violence.
Promote discrimination.
Infringe any copyright, database right or trade mark of any other person.
Be likely to deceive any person.
Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
Promote any illegal activity.
Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
Be likely to harass, upset, embarrass, alarm or annoy any other person.
Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
Suspension and termination
We will determine, in our discretion, whether there has been a breach of this policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.
Failure to comply with this policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:
Immediate, temporary or permanent withdrawal of your right to use our site.
Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
Issue of a warning to you.
If appropriate, legal proceedings against you for costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
Further legal action against you.
Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or are required, including but not limited to any law or court.
We exclude liability for actions taken in response to breaches of this policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
Discussion Forum Rules
This section, together with the Content Standards set out above set out the rules (Rules) for use of any discussion forum (the “Forum”) which may be made available to users. Any submission of material by you to the Forum means that you accept, and agree to abide by, all the terms and conditions of these Rules.
Moderation
The Forum may not be moderated. We will not be responsible as author, editor or publisher of any Contribution submitted to the Forum and we expressly exclude our liability for any loss or damage arising from the use of the Forum by any person in contravention of these Rules. We reserve the right to promptly remove, or to disable access to, any Contribution which we deem to be potentially defamatory of any person, unlawful or in violation of any third-party rights.
Use of the Forum by minors
The use of the Forum by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use the Forum that it is important that they communicate with their children about their safety online. Minors who are using the Forum should be made aware of the potential risks to them and of their obligation to comply with these Rules when using the Forum.
We will do our best to assess any possible risks to minors from third parties when they use the Forum, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks.
Submission of Contributions
To add a Contribution to a discussion, please follow the guidelines on the discussion page.
Content standards
The Content Standards set out above apply to each part of a Contribution as well as to its whole. The Content Standards must be complied with in spirit as well as to the letter. The Parochial Church Council will determine, in its discretion, whether a Contribution breaches the Content Standards.
Copyright
By submitting a Contribution to the Forum, you agree to grant the Parochial Church Council a non-exclusive licence to use that Contribution. Although you will still own the copyright in your Contribution, the Parochial Church Council will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Contribution. This licence will be free of charge, perpetual and capable of sub-licence. The Parochial Church Council may exercise all copyright and publicity rights in the material contained in your Contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
Please also note that, in accordance with the Content Standards set out above, you must ensure that your Contribution does not infringe any copyright, database right or trade mark of any other person. By submitting your Contribution to the Forum, you are warranting that you have the right to grant the Parochial Church Council the non-exclusive copyright licence described above.
If you are not in a position to grant such a licence to the Parochial Church Council, please do not submit the Contribution to the Forum.
Breach of these Rules
When we consider that a breach of the Content Standards has occurred, we may at our discretion take such action as we deem appropriate. Failure to comply with these Rules constitutes a material breach of the terms of use on which you are permitted to use the Forum, and may result in our taking all or any of the following actions:
Immediate, temporary or permanent withdrawal of your right to use the Forum.
Immediate, temporary or permanent removal of any Contribution already posted on the Forum.
Issue of a warning to you.
Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
Further legal action against you.
Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
We exclude our liability for all action we may take in response to breaches of these Rules. The actions described above are not limited, and we may take any other action we reasonably deem appropriate.
Complaints
If you wish to complain about any Contribution posted to the Forum, please contact us at parishoffice@allsaintswokingham.org.uk. We will then review the Contribution and decide whether it complies with our Content Standards. We will deal with any Contribution which, in our opinion, violates our Content Standards as described above (see section “Breach of these Rules”). We will inform you of the outcome of our review within a reasonable time of receiving your complaint.
Changes to these Rules
We may revise these Rules at any time. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
Applicable law
Please note that this policy, its subject matter and its formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
